Columbia Crest Winery’s "Flayvors of Washington" Contest

1. Two Ways to Enter: Columbia Crest Winery’s "Flayvors of Washington" Contest (the "Contest") begins at 12:01 a.m. (Eastern Time ["ET"]) on April 15, 2008 and ends at 12:00 a.m. (ET) on May 31, 2008 (the "Contest Period"). Participants must submit their original recipe for any course that features an ingredient(s) from Washington State and is inspired by a Columbia Crest Grand Estates wine. At least one Washington State ingredient (listed below) must be included in the recipe and a Columbia Crest Grand Estates wine (listed below) must be used in or paired with the dish from the lists provided. NO WINE PURCHASE REQUIRED. Participants may enter in either of the following ways: (i) online by visiting the Food Network website (the "Website") at www.foodnetwork.com/columbiacrest, and completing the online entry form (limit one (1) online entry, per valid e-mail address, per eligible person per day); or (ii) by regular mail by submitting your original recipe during the Contest Period to: "Flayvors of Washington Recipe Contest, P.O. Box 184, Florham Park, NJ 07932. Each entry must include the following: the entrant’s full name, age, address, e-mail, phone number, release forms, application, and the complete recipe. The recipe must include: a list of ingredients with exact US measurements, step-by-step preparation instructions highlighting the particular Washington State ingredient(s) that was used and the Columbia Crest Grand Estates wine that pairs with the dish, cooking instructions (time/temperature), number of servings yielded, and all other pertinent information. Entries must be received by 12:00 a.m. (ET) on May 31, 2008. Neither Television Food Network G.P. ("Food Network" or "Contest Host"), Columbia Crest Winery ("Columbia Crest" or "Sponsor") nor The TEAM Group, LLC ("TEAM" or "Contest Administrator") will verify receipt of entries.

2. Eligibility: To enter the Contest you must be a lawful permanent resident of the 50 United States or the District of Columbia and be 21 years of age or older. Entrants who have won a prize in any Food Network or Scripps Networks, LLC promotion in the 90 days prior to the commencement of the Contest are ineligible. Contest is void for residents of California, Tennessee, Utah, Puerto Rico, U.S. territories, possessions and commonwealths, and where restricted or prohibited by law. The Contest, and any website pages and advertisements relating thereto, is intended for viewing only within the United States. You are not authorized to participate in the Contest if you are not located within the United States. When you enter at the Website, you may be asked to consent to receive promotional e-mails and reminders for upcoming Columbia Crest’s promotions and information about Columbia Crest. Consenting to receive such e-mails is optional and does not have to be agreed to in order to be eligible to enter the Contest, and does not increase your chances of winning the Contest. In the event you do consent to receive these e-mails, the use of such e-mails shall be subject to the privacy policy of Columbia Crest, which is available at: http://www.columbia-crest.com/privacy.cfm. The Contest is not open to employees, or members of their households and/or immediate families (spouses, parents, siblings, children and each of their respective spouses) of Ste. Michelle Wine Estates, Columbia Crest, Food Network, The TEAM Group, LLC, participating affiliates, participating retailers, members of any state alcohol commission, and licensed alcohol beverage retailers and wholesalers, and their respective parent companies, subsidiaries, and affiliates, and their advertising and promotion agencies (collectively, the "Contest Entities"). The Contest is governed by U.S. law and is subject to all federal, state and local laws and regulations.

3. Winning/Notification: Ten (10) semifinalists (the "Semifinalists") will be selected based on how well the Washington state ingredient(s) was used, how well the recipe pairs with the Columbia Crest wine that served as its inspiration, and originality on or about July 11, 2008, from among all eligible entries received by 12:00 a.m. (ET) on May 31, 2008. Five (5) finalists (the "Finalists") will then be chosen on or about July 18, 2008 from the Semifinalist entries. The Finalists’ entries will be eligible for the First Prize which will be chosen on or about August 1, 2008. Judges’ decisions with respect to the prize winners and other matters pertaining to the Contest shall be final. If the Contest Entities are unable to contact a potential prize winner, if the potential prize winner fails to complete and return all forms by the specified date, or if potential prize winner fails to comply with any of the requirements, or if any prize or prize notification is returned as undeliverable, an alternate winner shall be selected for that prize. All entries will be received and reviewed by TEAM, an independent judging organization. The Judges will be rating each recipe on a five (5) point scale for each of the following four categories for a possible total of twenty (20) points:

  • How well the Washington State ingredient(s) (see list below) was used
  • How well the recipe pairs with the Columbia Crest Grand Estates wine (see list below) that served as its inspiration
  • Overall taste
  • Originality

Potential Finalists, will be notified by telephone and/or overnight mail delivery on a date in early August to be determined by Sponsor. In the event a prize notification letter or a prize is returned as undeliverable, such prize will be forfeited and awarded to an alternate winner selected from among all remaining eligible entries received.

4. Prizes: (A) One (1) First Place Prize: The first place winner ("First Place Winner") will be chosen from one (1) of the five (5) Finalists and shall win the following: (i) $500 cash; and (ii) a trip for the First Place Winner and one (1) guest to New York City consisting of the following: (a) round-trip coach class air transportation from the airport closest to First Place Winner’s residence; (b) first class hotel accommodations (double occupancy, room rate and tax only) for four (4) days/three (3) nights ("Hotel"); (c) ground transportation between the airport and Hotel in New York; (d) dinner for two (2) at a restaurant in New York City owned and operated by Bobby Flay; and (e) an opportunity to prepare First Place Winner’s winning recipe with Bobby Flay. Total Approximate Retail Value (ARV) of First Place Prize Package: $3,500.

(B) One (1) Second Place Prize: The second place winner (the "Second Place Winner") will receive the following: (i) one (1) signed copy of Bobby Flay’s Mesa Grill cookbook (Approximate Retail Value ("ARV"): $35); (ii) two (2) sets of Columbia Crest logo glassware (each set contains four (4) glasses) (ARV: $40); (iii) one (1) Columbia Crest logo corkscrew (ARV: $7); (iv) one (1) guidebook entitled Washington Wines & Wineries, The Essential Guide (ARV: $35); (viii) one (1) book entitled Washington: The State of Wine (ARV: $18.95); (v) one (1) Mesa Grill Steak Sauce (ARV: $10); (vi) one (1) Mesa Grill 16 Spice Poultry Rub (ARV: $7); (vii) a selection of items from the Bobby Flay at Kohl’s cookware line, including the following: (a) one (1) "Bobby Blender"; (b) one (1) pre-seasoned cast iron rectangular grilling griddle; (c) one (1) square carbon steel skillet; (d) one (1) large wood serve bowl; (e) one (1) large set of wood serving utensils; (f) one (1) wood serving board; (g) one (1) heavy-duty fork and slicer set; (h) one (1) heavy-duty wood steak knives; (i) one (1) standard spatula; (j) one (1) standard tong (ARV of utensil set: $346.91). Total ARV of the Second Place Prize: $499.86

(C) One (1) Third Place Prize: The third place winner (the "Third Place Winner") will win the following: (i) one (1) picnic basket (includes larger wicker picnic basket, blanket, cheese board, silverware, two (2) wine glasses, plates, salt & pepper shaker, wine bottle chiller (ARV: $200); (ii) one (1) set of Columbia Crest logo glassware (contains four (4) glasses) (ARV: $20); (iii) one (1) Columbia Crest logo corkscrew (ARV: $7); (iv) one (1) guidebook entitled Washington Wines & Wineries, The Essential Guide (ARV: $35); (v) one (1) signed copy of Bobby Flay’s Mesa Grill cookbook; (vi) one (1) Mesa Grill Steak Sauce (ARV: $10); and (vii) one (1) Mesa Grill 16 Spice Poultry Rub (ARV: $7). Total ARV of the Third Place Prize: $314.

Total ARV of all prizes in the Contest: $4,313.86

Hotel accommodations do not include other meals that are not described above, incidentals, tips, telephone calls, or any other personal expenses incurred during the trip. All other expenses not specifically identified as included in the prizes are the sole responsibility of each respective prize winner. All costs, taxes, fees, and expenses associated with any element of any prize not specifically addressed above are the sole responsibility of the respective prize winner. All federal, state and local taxes on prizes are the respective prize winners’ responsibility. Each respective prize winner will be issued a 1099 tax form for the cash value of their respective prize. The specifics of all aforementioned elements of each prize in the Contest shall be solely determined by the Contest Entities. If Sponsor is unable to furnish Bobby Flay in connection with the First Place Prize, no substitution or compensation will be given in lieu thereof; however, remainder of prize package will be awarded.

5. Prize Conditions: Potential winners will be required to execute an Affidavit of Eligibility, a Liability Release and a Publicity Release ("Affidavit/Release"), to be signed and returned within seven (7) days of notification date. If a potential winner is found to be ineligible, or if a winner or his/her travel companion fails to complete and return all requested forms by the specified date or if a winner fails to comply with any of the requirements, his/her prize will be forfeited and an alternate winner shall be selected. If prizes or prize notifications are returned as undeliverable, this will result in disqualification and an alternate winner will be selected. Except where prohibited by law, a potential winner’s entry and acceptance of a prize constitutes permission for Sponsor and Contest Host to use said potential winner’s name, photograph, likeness, statements, recipe (and other entry materials), biographical information, voice, and city and state address on a worldwide basis, and in all forms of media, in perpetuity, and without further compensation. Travel companion of the First Prize Winner must be 21 years of age or older, and will be required to sign publicity and liability releases, and return same, properly executed, prior to issuance of travel documents. The First Prize Winner and travel companion must travel on the same itinerary and on dates designated by Sponsor. The trip to New York City is subject to availability and the travel dates as designated by Sponsor. In the event that the First Prize Winner and their travel companion cannot travel on designated dates, the prize will be forfeited and awarded to an alternate winner. All travel arrangements/accommodations are at Sponsor’s discretion. Any prize cannot be transferred, substituted or redeemed for cash except at Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize, or portions thereof, with a prize of equal or greater value. All prizes will be awarded. Entries/Recipes become the property of the Contest Entities, and cannot be returned.

6. Contest Conditions: Sponsor reserves the right to modify the winning recipe in any way and for any reason, including but not limited to ingredient unavailability, copyright and trademark purposes, clarity in order to ensure a wholesome product for its customers. Sponsor reserves the right to alter the name or title of the winning recipe. Sponsor will own all rights to each winning recipe. To the extent entrant has any rights in a winning recipe, entrant assigns all such rights to Sponsor by accepting a prize and agrees as a condition to accepting a prize to sign any relevant documentation requested by Sponsor. The Contest Entities and/or their assigned agent(s), will have the right to reproduce, publish, adapt, modify and/or revise the video/recipe, in its sole discretion, in any manner or form throughout the world, in perpetuity. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor and Contest Administrator, which shall be final and waive any right to claim ambiguity in the Contest or these Official Rules. Winners and entrants also agree to release, discharge, indemnify and hold harmless the Contest Entities and each of their respective officers, directors, employees, representatives and agents from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Contest-related activity or participation in this Contest. This Contest is subject to all applicable Federal and Municipal laws and all State and local regulations. This offer is void where prohibited and/or restricted by law.

7. Limitations of Liability: The Contest Entities, their respective affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees and agents, and any and all Internet servers and access provider(s) are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this Contest; inability to access the Website; theft, tampering, destruction, or unauthorized access to, or alteration of entries; transactions that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any web site; printing or human or other errors; and any entries which are late, lost, incomplete, misdirected, stolen, mutilated, illegible or postage due, or any combination thereof. Proof of mailing, in person submission, or online submission is not considered proof of delivery or receipt. Sponsor may prohibit an entrant from participating in the Contest or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or any other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives. If for any reason this Contest is not capable of running as planned, including, but not limited to tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt in any way or affect the administration, security, fairness, integrity, fulfillment or proper conduct of the promotion, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest and select a winner by randomly drawing from those entries received up to the cancellation/suspension date. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
