Official Rules

CONTEST IS OPEN TO LEGAL RESIDENTS OF THE 48 CONTIGUOUS UNITED STATES AND THE DISTRICT OF COLUMBIA, 18 YEARS OR OLDER, AND SHALL BE CONSTRUCTED AND EVALUATED ACCORDING TO U.S. LAW. DO NOT ENTER THIS CONTEST IF YOU ARE NOT LOCATED IN THE 48 CONTIGUOUS UNITED STATES OR THE DISTRICT OF COLUMBIA.

NO PURCHASE NECESSARY.

ELIGIBILITY: The Food Network "Good Eats 10th Anniversary – Great Fan' Contest (the "Contest") is open to all legal residents of the 48 contiguous United States and the District of Columbia, age 18 years of age or older, except employees, officers, directors, agents (and their immediate families [spouse, parent, child, sibling and their respective spouses] and household members [whether or not related]) of Television Food Network, G.P. (the "Sponsor"), and its respective parents, subsidiaries, divisions, trustees, franchisees, participating vendors, distributors, advertising and promotion agencies and affiliated entities (collectively, with the Sponsor, "Contest Entities"). Void where prohibited by law. Contest is governed by U.S. law and subject to all applicable federal, state and local laws and regulations. By entering the Contest, entrants agree to accept and be bound by all terms of these Official Rules and Regulations ("Official Rules").

HOW TO ENTER: From 3:00 p.m. Eastern Time ("ET") on July 10, 2009 through 9:00 a.m. ET on August 7, 2009 (the "Promotion Period"), Sponsor will conduct a national skill contest encouraging participants to demonstrate why they are a Good Eats Great Fan. To enter this Contest, participants may visit www.Foodnetwork.com/goodeats, complete the online entry form in its entirety, and follow the online instructions to upload a video or photo based on one (1) of the following themes: i) why they consider themselves a Good Eats Great Fan; ii) a 10th anniversary tribute to the Good Eats show (without using show footage); or iii) a recipe preparation ala Good Eats. The entry form including video or photograph will be referred to collectively as the "Submission." To be eligible: (i) each entry must be received no later than 9:00 a.m. ET on August 7, 2009 and (ii) all videos must be :60 or less in length and cannot exceed 100 MB, all photographs cannot exceed 100 MB. All entries must be submitted in the name of an individual person and the prize can only be awarded to the person whose name is on the winning entry. All entries must be in English. Entrant warrants and represents: (a) he/she is the sole and exclusive author and owner of the Submission, including all rights therein, and that the video or photograph has not won any previous awards or competitions; (b) entrant has the full and exclusive right, power and authority to submit the Submission and to grant the Contest Entities the rights to the Submission, including but not limited to the worldwide copyright; (c) no part of the Submission has been aired or published, or; (d) no rights in the Submission have been previously granted to any person, firm, corporation or other entity; (e) that you have obtained permission from any person whose name or likeness is used in the Submission and that such person is 18 years of age or older, or, if any person whose name or likeness is used in the Contest Entry is under the age of 18, that you are the parent/legal guardian of said person. Sponsor reserves the right in their sole discretion to disqualify any Submission at any time in the event it is determined that the Submission is offensive, inappropriate, not in keeping with Sponsor's images or if it is determined that the entrant has not otherwise complied with these Official Rules. If the Submission contains any material or elements that are not owned by the entrant and/or which are subject to the rights of third parties, the entrant is responsible for obtaining, prior to submission of the Submission, any and all releases and consents necessary to permit the use and exhibition of the Submission by Sponsor in the manner set forth in these Official Rules. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any participant at any time. Entries generated by script, macro or other automated means will be void. The Contest Entities are not responsible for misdirected, incomplete, lost, late, or inaccurate entries, nor for technical, hardware, or software failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions or other errors or problems which may limit or affect a person's ability to participate in the Contest, whether human, mechanical, typographical, printing, electronic, network or otherwise, relating to or in connection with the Contest, including, without limitation, errors which may occur in connection with the administration of the Contest, the processing of entries, the announcement of the prize or in any Contest-related materials. Proof of submission is not considered proof of delivery or receipt. In the event of sabotage, acts of God, terrorism or threats thereof, computer virus or other events or causes beyond the Sponsor's control, which corrupt the integrity, administration, security or proper operation of the Contest, Sponsor reserves the right, in their sole discretion, to modify, cancel or suspend the Contest. In the event of cancellation, Sponsor reserves the right to judge all eligible, non-suspect Submissions received prior to the event requiring such cancellation using the judging procedure outlined below. False or deceptive Submissions or acts will render the entrant ineligible. Each entrant hereby acknowledges and agrees that the relationship between entrant and Sponsor is not a confidential, fiduciary, or other special relationship, and that entrant's decision to submit his/her Submission to Sponsor for purposes of the Contest does not place Sponsor in a position that is any different from the position held by members of the general public with regard to elements of entrant's Submission. By entering this Contest, entrant acknowledges and agrees that Sponsor may receive many Submissions under this Contest and that such Submissions may be similar or identical in theme, idea, format or other respects to others submitted under the terms of this Contest and/or other contests staged and/or sponsored by Sponsor, and waive any and all claims entrant may have had, may have, and/or may have in the future, that any Submissions and/or other works accepted, reviewed and/or used by other entrants and/or Sponsor (or their designees) may be similar to entrant's Submission. Entrant acknowledges and agrees that Sponsor has not, nor shall have in the future, any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of any copyright in and to entrant's Submission. Limit: one (1) Submission per person or e-mail address per day. All entries become the property of Sponsor and will not be returned.

HOW TO WIN/JUDGING: Starting at 5:00 p.m. ET on August 7, 2009 through 5:00 p.m. ET on August 12, 2009 a representative from Food Network will review each of the eligible Submissions and rank them based on the below Judging Criteria. The six (6) submissions with the highest scores will be the overall winners. The decision of the judges will be final and binding in all matters. The Winners will be confirmed by U.S. mail, e-mail and/or telephone and must meet all eligibility requirements including the timely execution and return of all necessary releases and documents required by Sponsors. The winning Submissions may be featured on the Good Eats 10th Anniversary special.

Eligible Submissions will be judged on the following weighted basis (the "Judging Criteria"):

  • (i) Creativity/Originality – 50%
  • (ii) Presentation and Communication Effectiveness – 25%
  • (iii) Relevance to theme – 25%

In the event of a tie, the entries involved will be re-judged by a different judge who will serve as the tiebreaker.

PRIZE: Six (6) Winners will each receive a trip for two (2) persons to Atlanta, GA (the "Prize") August 28-31, 2009. Trip includes the following: (i) round-trip coach class transportation for two (2) from the major airport nearest winner's U.S. home; (ii) rental car in Atlanta (some restrictions may apply); (iii) 4 days/3 nights hotel accommodations (1 room, double occupancy); (iv) two (2) tickets to a Good Eats 10th Anniversary Show; and (v) two (2) tickets to the VIP Post-Show;. The Approximate Retail Value (ARV) of each Prize is $2,158.00. The total ARV of the 6 Prizes to be awarded is $12,948.00. This trip must be taken August 28, 2009 – August 31, 2009. If a Winner is unable to travel on the above specified dates, the prize will be forfeited and an alternate winner selected. Rental car is subject to availability and rental provider's terms and conditions.

Although Winners will be participating in a live show, their entry may not end up in the final edited version of the show for broadcast. Show executives will review the two (2) shows with the entry performances and may select one to be included in the broadcast.

The specifics of all aforementioned elements of the Prize in the Contest shall be solely determined by Sponsor. All costs, taxes, fees, and expenses (including, but not limited to meals, beverages, incidentals, tips, or other personal expenses) associated with acceptance and use of any element of the Prize not specifically addressed above as being awarded are the sole responsibility of the Winners. Prize travel arrangements subject to availability, some restrictions may apply and may require connecting flights. Winner and travel companion must travel on the same itinerary (at the same time and to and from the same city). All travel is subject to availability. Once travel arrangements have been made and tickets have been purchased, travel may only be altered at the sole expense of the winner. No substitution or transfer of prizes permitted, except at the sole discretion of the Sponsor. Sponsor reserves the right to substitute for any reason whatsoever a prize (or portion thereof) of comparable or greater value, at their sole discretion. Winners are responsible for the reporting and payment of all taxes (if any) associated with acceptance and use of a prize not specified herein.

GENERAL RULES AND REGULATIONS: By entering this Contest, participants grant Contest Entities and their designees the right, unless prohibited by law, to use their names, cities and states of residences, voices, pictures and likenesses, without compensation, notification or approval, for the purpose of advertising and publicizing the goods and services of the Contest Entities and all matters related to the Contest, in any manner or medium, now or hereafter known, throughout the world in perpetuity. Winners will be required to execute an Affidavit of Eligibility, a Liability Release, a tax acknowledgment form and, except where prohibited by law, a Publicity Release, and return those items within three (3) days of issuance of notification. Travel companion of each Winner must be 18 years of age or older or accompanied by a parent or legal guardian if a minor, and will be required to sign publicity and liability releases, and return same, properly executed, prior to issuance of travel documents. Noncompliance within this time period or failure of a potential Winner to respond to a notification attempt within three (3) days of such attempt may result in disqualification and, at Sponsor's sole discretion, an alternate winner may be selected. If: (i) any prize or prize notification is returned as undeliverable, (ii) a potential Winner declines his or her prize, (iii) a potential Winner fails to comply with any of the Official Rules as outlined herein, such potential Winner will be disqualified and an alternate Winner will be selected by the Judges, based on the Judging Criteria, at the Sponsor's sole discretion. With respect to each participant's submission, entrants hereby irrevocably grant Sponsor, consistent with copyright ownership, the exclusive, perpetual, worldwide right to use the Submission and Submission materials, in whole or in part, alone or in combination with other material, or as a basis for new material, as Sponsor may determine in their sole discretion and for the purposes of advertising and promoting the Contest and/or the exhibitors thereof, and to use the Submission and/or Submission materials in connection with the Contest and related advertising and promotion or otherwise, but not as a direct endorsement for any product. Without limiting the generality of the foregoing, participants agree that the rights granted hereunder shall include, but not be limited to, the perpetual, worldwide right of Sponsor and their designees to use, edit, adapt, arrange, telecast, cablecast, rerun, record, publish, reproduce, license, print, distribute and/or otherwise exploit, in any language and in all media now known or hereafter devised, the Submission and/or Submission materials in whole or in part, without any further compensation to participant. Participants may be required to execute any documents necessary to perfect such rights to the Sponsor. The Contest Entities expressly disclaim any responsibility and entrants agree to indemnify and hold harmless the Contest Entities from and against any and all claims, actions, demands and/or liability for injury, damage or loss whatsoever relating to or arising in connection with participation in this Contest (regardless of the cause of such injury, damage or loss) and/or the delivery and/or subsequent use or misuse of the prize awarded (including any travel or activity related thereto).

OFFICIAL RULES OR WINNER LIST REQUESTS: For a copy of the Official Rules or the Winners names, send a self-addressed, stamped envelope (no later than August 13, 2009 for the Official Rules and no later than August 31, 2009 for the Winner's List) to the following address: Food Network's "Good Eats 10th Anniversary – Great Fan' Contest, P.O. Box 233, Florham Park, NJ 07932. Indicate "Rules Request" or "Winners Names Request" on the front of your envelope. The winning Submissions will also be featured on the Good Eats 10th Anniversary Special.
