ELIGIBILITY: The Kia “What’s Your Forte” Sweepstakes (the “Sweepstakes”) is open to all legal residents of the 48 contiguous United States and the District of Columbia, who are 18 years of age or older as of August 17, 2009 and who had Internet access on or before August 17, 2009. Scripps Networks, LLC (the “Sponsor”), Kia Motors America, Inc. , Television Food Network, G.P., and each of their respective employees, officers, directors, agents, and their respective parents, subsidiaries, divisions, trustees, franchisees, participating vendors, distributors, advertising and promotion agencies and affiliated entities (collectively, with the Sponsor, the "Sweepstakes Entities") and their immediate families (spouse, parent, child, sibling and their respective spouses) and household members (whether or not related) are not eligible to participate in the Sweepstakes. Void in Hawaii, Alaska, Puerto Rico, and wherever prohibited by law. The Sweepstakes is governed by U.S. law and subject to all applicable federal, state and local laws and regulations. By entering the Sweepstakes, entrants agree to comply with and be bound by all terms of these Official Rules, including eligibility requirements.
PRIZES/PRIZE CONDITIONS:
Grand Prize: One (1) Grand Prize Winner will receive a KitchenAid® Appliance Makeover, which shall consist of appliances to be determined in the sole discretion of Sweepstakes Entities (gadgets, cookware, bake ware, cutlery not included). (Approximate Retail Value (“ARV”) for Grand Prize: $10,000.)
First Prize: One (1) First Prize Winner will receive a $5,000 Gift Card to a home improvement store of their choice (ARV for First Prize: $5,000.)
Second Prize: One (1) Second Prize Winner will receive cleaning robots from iRobot® iRoomba and iRobot® iScooba. (ARV for Second Prize: $1,000.)
Weekly Prizes: Nine (9) Weekly Prize Winners (one (1) winner per week throughout the Promotion Period) will each receive a $500 Gift Card to a home improvement store of their choice (ARV for all Weekly Prizes is $4,500).
Total ARV for all twelve (12) prizes: $20,500.
The Grand, First, Second, and Weekly Prize Winners (collectively, the “Winners”) are responsible for the reporting and payment of all federal, state and local taxes (if any). Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. All costs and expenses not stated herein as being provided in connection with the acceptance, redemption, receipt and/or use of the prizes are the responsibility of Winners, including, but not limited to, any installation or similar charges. All prize details are at Sponsor’s sole discretion.
HOW TO ENTER: The Sweepstakes will begin at 9:00 a.m. Eastern Time (“ET”) on August 17, 2009 and end at 5:00 p.m. ET on October 19, 2009 (the “Promotion Period”). To enter during the Promotion Period visit www.foodnetwork.com/whatsyourforte and complete and submit the online entry form in its entirety.
Each week during the Promotion Period, running from 12:00 a.m. ET Monday through 11:59 p.m. ET Sunday (the “Weekly Entry Period”), for nine (9) weeks, a drawing will be held from all eligible entries received.
Limit: one (1) entry per valid email address, per person per day. All entries must be in English. The Sponsor reserves the right in its sole discretion to disqualify any entry if it is determined that the entrant has not complied with these Official Rules. Entries generated by script, macro or other automated means will be voided. The Sweepstakes Entities are not responsible for late, lost, incomplete, or misdirected entries, unauthorized access to or alteration of entries, injury or damage to any person's computer, nor for website or Internet-related technical, hardware, or software failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions or other errors or problems which may limit or affect a person’s ability to participate in the Sweepstakes, whether human, mechanical, typographical, printing, electronic, network or otherwise, relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes or in any Sweepstakes-related materials. Proof of online submission is not considered proof of delivery or receipt. In the event of sabotage, acts of God, terrorism or threats thereof, computer virus or other events or causes beyond the Sponsor’s control, which corrupt the integrity, administration, security or proper operation of the Sweepstakes, the Sponsor reserves the right, in its sole discretion, to modify, cancel or suspend the Sweepstakes. In the event of modification, cancellation, or suspension, the Sponsor reserves the right to select winners from among all eligible, non-suspect entries received prior to the event requiring such modification, cancellation, or suspension. False, tampered with or altered or deceptive entries and other false, deceptive or disruptive acts will render the entrant ineligible. Each entrant hereby acknowledges and agrees that the relationship between entrant and the Sponsor is not a confidential, fiduciary, or other special relationship. All entries become the property of the Sponsor and will not be acknowledged or returned.
When you enter at www.foodnetwork.com/whatsyourforte , you may be asked by the Sponsor to consent to receive promotional e-mails and reminders for upcoming promotions and information about their product or services. Consenting to receive such e-mails is optional and does not have to be agreed to in order to be eligible to enter the Sweepstakes and does not improve your chances of winning. In the event you do consent to receive these e-mails, the information provided by you to participate in this Sweepstakes and the use of such e-mails is subject to the Sponsor’s privacy policy located at http://www.scrippsnetworks.com/privacy.aspx
HOW WINNERS WILL BE DETERMINED: The nine (9) Weekly Prizes will be awarded as follows: one (1) winner each week for nine (9) weeks will be selected in a random drawing on or about the Tuesday following each Weekly Entry Period from among all eligible entries received for such Weekly Entry Period. All non-winning entries from previous Weekly Entry Periods will be rolled over into subsequent Weekly Entry Periods. The prospective Grand, First, and Second Prize Winners will be selected in a random drawing from among all eligible entries on or about October 23, 2009. All prospective Winners will be selected by an independent judging organization, and will be contacted by phone and/or in writing within approximately seven (7) days of each respective drawing. Judge’s decisions with respect to all winners and other matters pertaining to the Sweepstakes shall be final and binding. The odds of winning will depend upon the number of eligible entries received for each respective drawing.
GENERAL TERMS & CONDITIONS: The prospective Grand, First, and Second Prize Winners will each be required to sign an Affidavit of Eligibility, Release of Liability and, to the extent permitted by law, a Publicity Release, and return same, properly executed, within ten (10) days of issuance of prize notification. Such documents will be binding and effective upon signature, and shall encompass all Sweepstakes Entities. Grand, First, and Second Prize Winners will be issued a 1099 tax form for the ARV of their prize. If (i) Sponsor is unable to contact a prospective Winner or prospective Winner does not respond to prize notification within the timeframe stated, (ii) the prize notification is returned as undeliverable, (iii) prospective Winner declines his or her prize, (iv) prospective Winner fails to complete all required documents to the satisfaction of Sponsor as determined in its sole discretion and return all required documents within the timeframe stated, (v) prospective Winner fails to comply with any of the provisions of these Official Rules; or (vi) prospective Winner is found ineligible as determined in Sponsor’s sole discretion, it will result in the disqualification of such prospective Winner and an alternate prospective Winner may be selected by random drawing at Sponsor’s sole discretion. Some restrictions may apply. No substitution or transfer of prizes or cash redemptions permitted, except at the sole discretion of the Sponsor. Sponsor reserves the right to substitute the prize, or portions thereof, with a prize of equal or greater value. All prizes will be awarded.
Winners acknowledge and agree that as a condition of winning, Sponsor and its respective designees have the right to use his/her name, likeness, photograph, voice, city and state of residence, biographical information, statements, video, and prize information for advertising and promotional purposes in any and all media now known or hereafter devised, worldwide in perpetuity, without further compensation, authorization, remuneration or notification, except where prohibited by law.
In the event of a dispute as to the identity of an online winner based on an e-mail address, the winning entries will be declared made by the authorized account holders of the e-mail address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
Entrants, by participating, agree that Sweepstakes Entities will have no liability whatsoever for and shall be indemnified, released and held harmless by entrants from and against any and all claims, demands, liabilities, costs, expenses, injuries, losses or damages of any kind (including without limitation any property loss, damage, personal injury or death) caused by, arising out of, relating to, incurred in connection with or resulting, in whole or in part, directly or indirectly from acceptance, possession or use/misuse of any prize (including any travel or activity related thereto) and/or participating in this Sweepstakes and/or any prize-related activities.
