Official Rules

CONTEST IS OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA, 17 YEARS OF AGE OR OLDER, AND SHALL BE CONSTRUCTED AND EVALUATED ACCORDING TO U.S. LAW. VOID IN PUERTO RICO AND WHERE PROHIBITED BY LAW.

ELIGIBILITY: "Chef Jeff Project Contest Scholarship" Essay Contest (the "Contest") is open to all legal residents of the 50 United States and the District of Columbia, 17 years of age or older, except employees, officers, directors, agents (and their immediate families [spouse, parent, child, sibling and their respective spouses] and household members (whether or not related) of The Art Institutes International LLC (the "Sponsor"), and their respective parents, subsidiaries, divisions, trustees, franchisees, participating vendors, distributors, advertising and promotion agencies and affiliated entities (collectively, with the Sponsor, "Contest Entities"). No purchase necessary to enter or win. Void in Puerto Rico and wherever prohibited by law. Contest is governed by U.S. law and subject to all applicable federal, state and local laws and regulations. By entering the Contest, entrants agree to accept and be bound by all terms of these Official Rules and Regulations ("Official Rules"). Limit one (1) entry per person or e-mail address.


HOW TO ENTER: From 5:00 p.m. Eastern Time ("ET") on October 8, 2008 through 5:00 p.m. ET on November 25, 2008 (the "Entry Period"), Sponsor will conduct a national contest encouraging participants to submit an essay, no more than 2500 characters (including spaces), based on the following criteria: (i) ability to clearly communicate a specific culinary career goal/vision (ii) originality of story; (iii) degree of passion/conviction for pursuing a culinary education; To enter during the Entry Period, visit www.foodnetwork.com/scholarship, complete the online entry form in its entirety, including your essay answering the above statements/questions, and submit. (The entry form and the Essay will be referred to collectively as the "Submission.") To be eligible, each Submission must be received no later than 5:00 p.m. ET on November 25, 2008. All Submissions must be submitted in the name of an individual person and the prize can only be awarded to the person whose name is on the winning Submission. All Submissions must be in English. Entrant warrants and represents: (a) he/she is the sole and exclusive author and owner of the Submission, including all rights therein, and that the Essay has not won any previous awards or competitions; (b) entrant has the full and exclusive right, power and authority to submit the Submission and to grant the Contest Entities the rights to the Submission, including but not limited to the worldwide copyright; (c) no part of the Submission has been aired, and; (d) no rights in the Submission have been previously granted to any person, firm, corporation or other entity. Sponsor reserves the right in their sole discretion to disqualify any Submission at any time in the event it is determined that the Submission is offensive, inappropriate, not in keeping with Sponsor's images or if it is determined that the entrant has not otherwise complied with these Official Rules. If the Submission contains any material or elements that are not owned by the entrant and/or which are subject to the rights of third parties, the entrant is responsible for obtaining, prior to submission of the Submission, any and all releases and consents necessary to permit the use and exhibition of the Submission by Sponsor in the manner set forth in these Official Rules. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any participant at any time. Any Submission generated by script, macro or other automated means will be void. The Contest Entities are not responsible for incomplete, lost, late, or inaccurate entries, nor for technical, hardware, or software failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions or other errors or problems which may limit or affect a person's ability to participate in the Contest, whether human, mechanical, printing, electronic, network or otherwise, relating to or in connection with the Contest, including, without limitation, errors which may occur in connection with the administration of the Contest, the processing of Submissions, the announcement of the prizes or in any Contest-related materials. Proof of online submission is not considered proof of delivery or receipt. In the event of sabotage, acts of God, terrorism or threats thereof, computer virus or other events or causes beyond the Sponsor's control, which corrupt the integrity, administration, security or proper operation of the Contest, Sponsor reserves the right, in their sole discretion, to modify, cancel or suspend the Contest. In the event of cancellation, Sponsor reserves the right to judge all eligible, non-suspect Submissions received prior to the event requiring such cancellation using the judging procedure outlined below. False or deceptive Submissions or acts will render the entrant ineligible. Each entrant hereby acknowledges and agrees that the relationship between entrant and Sponsor is not a confidential, fiduciary, or other special relationship, and that entrant's decision to submit his/her Submission to Sponsor for purposes of the Contest does not place Sponsor in a position that is any different from the position held by members of the general public with regard to elements of entrant's Submission. By entering this Contest, entrant acknowledges and agrees that Sponsor may receive many Submissions under this Contest and that such Submissions may be similar or identical in theme, idea, format or other respects to others submitted under the terms of this Contest and/or other contests staged and/or sponsored by Sponsor, and waive any and all claims entrant may have had, may have, and/or may have in the future, that any Submissions and/or other works accepted, reviewed and/or used by other entrants and/or Sponsor (or their designees) may be similar to entrant's Submission. Entrant acknowledges and agrees that Sponsor has not, nor shall have in the future, any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of any copyright in and to entrant's Submission. All entries become the property of Sponsor and will not be returned.


PRIVACY: When you enter at www.FoodNetwork.com you may be asked to consent to receive promotional e-mails and reminders for upcoming The Art Institutes promotions and information about The Art Institutes and/or consent to be contacted by an Art Institutes admissions representative. Consenting to receive such e-mails is optional and does not have to be agreed to in order to be eligible to enter the Contest and does not improve your chances of winning. In the event you do consent to receive these e-mails, the use of such e-mails shall be subject to the privacy policy of The Art Institutes, which is available at http://www.artinstitutes.edu/PrivacyPolicy/Default.aspx.


HOW TO WIN/JUDGING: Starting on or about December 1, 2008, all eligible submissions will be judged based on above mentioned criteria, by an independent judging panel that will narrow down the entries to a select pool of top finalists, with the top five (5) finalists (the ?Finalists?) to be selected by Sponsor and Food Network.


Starting on or about January 2, 2009 the Finalists will be re-evaluated by Chef Jeff and representatives from The International Culinary Schools at The Art Institutes, based on above mentioned criteria, who will determine the overall Grand Prize winner ("Winner").


In the event of a tie, the entries involved will be re-judged by a different judge who will serve as the tiebreaker. The decision of the judges will be final and binding in all matters. The Winner will be confirmed by U.S. mail, e-mail and/or telephone and must meet all eligibility requirements including the timely execution and return of all necessary releases and documents required by Sponsor.


PRIZE: The "Chef Jeff Project Contest Scholarship" will award one (1) Grand Prize consisting of a $20,000 Chef Jeff Project Scholarship toward a culinary arts bachelor's or associate's degree program at any of The Art Institutes US locations. Approximate Retail Value (ARV) of this prize is $20,000. No substitution or transfer of prize or cash redemptions permitted, except at the sole discretion of the Sponsor. Sponsor reserves the right to substitute for any reason whatsoever a prize (or portion thereof) of comparable or greater value, at its sole discretion. The Winner is responsible for the reporting and payment of all taxes (if any) or other costs and expenses associated with acceptance and use of a prize not specified herein. A bachelor's degree program costs approximately $80,000 and an asociate's degree program costs approximately $50,000. Winner or parent/legal guardian is responsible for the remaining tuition and other costs above and beyond the $20,000 scholarship. Scholarship will be awarded only to an individual who has submitted an application for admission to one of The Art Institutes schools and such application has been accepted. Scholarship may be used only at an Art Institutes school location in the United States and only for a culinary arts program. The scholarship is not redeemable for cash and may not be used to finance optional programs sponsored by The Art Institutes schools. The scholarship covers tuition only and may not be applied against fees, housing, living expenses, or program supplies, and may not be transferred between affiliate schools of The Art Institutes. Scholarship money awarded will be prorated during the length of the student's degree program. In the event education is terminated either by the student or The Art Institutes school, the scholarship becomes null and void; any future quarter scholarship dollars not used will be revoked and will not be available upon re-entry. In the event that the first place Finalist does not qualify to receive the scholarship or otherwise elects not to accept the scholarship, Sponsor reserves the right to offer the scholarship to an alternate Finalist. In the event that none of the Finalists qualify to receive the scholarship or otherwise elect not to accept the scholarship, Sponsor reserves the right not to award the scholarship.


GENERAL RULES AND REGULATIONS: The potential winner must be able to redeem scholarship within two (2) years after it is awarded and meet all admissions requirements of The Art Institutes school to which they apply, as published in its current academic catalog at the time of application.


By entering this Contest, Entrants grant Contest Entities and their designees the right, unless prohibited by law, to use their names, cities and states of residences, voices, pictures, likenesses, and entrant's submission without compensation, notification or approval, for the purpose of advertising and publicizing the goods and services of the Contest Entities and all matters related to the Contest, in any manner or medium, now or hereafter known, throughout the world in perpetuity. Winner may be required to execute an Affidavit of Eligibility, a Liability Release, a Tax Acknowledgment Form and, except where prohibited by law, a Publicity Release, and return those items within ten (10) business days of issuance of notification. Noncompliance within this time period or failure of a potential Winner to respond to a notification attempt within ten (10) days of such attempt may result in disqualification and, at Sponsor's sole discretion; an alternate winner may be selected. The payment of all applicable taxes including income taxes on prizes, and the determination as to whether or to what extent prizes are tax exempt, is the responsibility of the winners.


If: (i) any prize or prize notification is returned as undeliverable, (ii) a potential Winner declines his or her prize, (iii) a potential Winner fails to comply with any of the Official Rules as outlined herein, such potential Winner will be disqualified and an alternate Winner will be selected by the Judges, based on the criteria, at the Sponsor's sole discretion. With respect to each participant's submission, entrants hereby irrevocably grant Sponsor, consistent with copyright ownership, the exclusive, perpetual, worldwide right to use the Essay and Submission materials, in whole or in part, alone or in combination with other material, or as a basis for new material, as Sponsor may determine in their sole discretion and for the purposes of advertising and promoting the Contest and/or the exhibitors thereof, and to use the Essay and/or Submission materials in connection with the Contest and related advertising and promotion or otherwise, but not as a direct endorsement for any product. Without limiting the generality of the foregoing, participants agree that the rights granted hereunder shall include, but not be limited to, the perpetual, worldwide right of Sponsor and their designees to use, edit, adapt, arrange, telecast, cablecast, rerun, record, publish, reproduce, license, print, distribute and/or otherwise exploit, in any language and in all media now known or hereafter devised, the Essay and/or Submission materials in whole or in part, without any further compensation to participant. Entrants may be required to execute any documents necessary to perfect such rights to the Sponsor. The Contest Entities expressly disclaim any responsibility and entrants agree to indemnify and hold harmless the Contest Entities from and against any and all claims, actions, demands and/or liability for injury, damage or loss whatsoever relating to or arising in connection with participation in this Contest (regardless of the cause of such injury, damage or loss) and/or the delivery and/or subsequent use or misuse of the prize awarded (including any travel or activity related thereto).


OFFICIAL RULES OR WINNER LIST REQUESTS: Beginning on or about January 15, 2009, you may obtain the name of the prize winner by visiting www.FoodNetwork.com. Results of the drawing will be removed from www.FoodNetwork.com on or about March 30, 2009.
