SWEEPSTAKES IS OPEN TO LEGAL RESIDENTS OF THE 48 CONTIGUOUS UNITED STATES AND THE DISTRICT OF COLUMBIA, 18 YEARS OR OLDER, AND SHALL BE CONSTRUCTED AND EVALUATED ACCORDING TO U.S. LAW. DO NOT ENTER THIS SWEEPSTAKES IF YOU ARE NOT LOCATED IN THE 48 CONTIGUOUS UNITED STATES OR THE DISTRICT OF COLUMBIA.

ELIGIBILITY: "The Next Food Network Star 5: Fan Favorite Vote" Sweepstakes (the "Sweepstakes") is open to all legal residents of the 48 contiguous United States and the District of Columbia, age 18 years of age or older, except employees, officers, directors, agents (and their immediate families [spouse, parent, child, sibling and their respective spouses] and household members [whether or not related]) of Huhtamaki Foodservice, Inc. (the "Sponsor"), Summer Classics and Viking Range Corporation (the "Prize Providers"), and their respective parents, subsidiaries, divisions, trustees, franchisees, participating vendors, distributors, advertising and promotion agencies and affiliated entities (collectively, with the Sponsor, the "Sweepstakes Entities"). Void in Hawaii, Alaska, Puerto Rico, and wherever prohibited by law. Sweepstakes is governed by U.S. law and subject to all applicable federal, state and local laws and regulations. By entering the Sweepstakes, entrants agree to accept and be bound by all terms of these Official Rules.

PRIZES/PRIZE CONDITIONS: One (1) Grand Prize Winner will receive the following products from Summer Classics, Viking Grill, and Chinet: (i) Quattro Slatted Aluminum Dining Table, Approximate Retail Value (ARV) $1,874 ; (ii) Two (2) Alabaster Arm Chairs, ARV $1,146; (iii) Four (4) Alabaster Side Chairs, ARV $2,132; (iv) Six (6) Sunbrella Chair Cushions (Fife Antique Beige), ARV $480; (v) Six (6) Throw Pillows (Discus Coffee Bean), ARV $354; (vi) 9' Umbrella (Discus Coffee Bean), ARV $600; and (vii) Concrete Umbrella Base, ARV $104; (viii) Viking Grill and Cart, ARV $7,000; and (ix) thirty-six (36) $5.99 coupons for Chinet (R) paper plates, ARV $215.64. The Approximate Retail Value (ARV) of this Grand Prize package is $13,905.64

No substitution or transfer of prizes or cash redemptions permitted, except at the sole discretion of the Sponsor. Sponsor reserves the right to substitute for any reason whatsoever a prize (or portion thereof) of comparable or greater value, at their sole discretion. Prizes are awarded "as is" with no warranty or guarantee, either express or implied by Sponsor. The Winner is responsible for the reporting and payment of all taxes (if any) as well as any delivery or installation charges or other costs and expenses associated with acceptance and use of a prize not specified herein.

HOW TO ENTER: The Sweepstakes will begin at 9:00 p.m. Eastern Time ("ET") on June 7, 2009 and end at 9:00 a.m. ET on August 4, 2009 (the "Promotion Period"). To enter during the Promotion Period visit http://www.foodnetwork.com/the-next-food-network-star-fan-vote/package/index.html and complete and submit the online entry form in its entirety, including your vote for the Next Food Network Star finalist you would have eliminated. All entries must be received by 9:00a.m. Eastern Time ("ET") on August 4, 2009 in order to be eligible.

Voting for the Next Food Network Star you would have eliminated is required in order to be entered into the sweepstakes. Limit: one (1) online entry per valid email address, per person per day. All entries must be in English. Sponsor reserves the right in their sole discretion to disqualify any Submission if it is determined that the entrant has not complied with these Official Rules. Entries generated by script, macro or other automated means will be voided. The Sweepstakes Entities are not responsible for Internet-related technical, hardware, or software failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions or other errors or problems which may limit or affect a person's ability to participate in the Sweepstakes, whether human, mechanical, typographical, printing, electronic, network or otherwise, relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes or in any Sweepstakes-related materials. Proof of online submission is not considered proof of delivery or receipt. In the event of sabotage, acts of God, terrorism or threats thereof, computer virus or other events or causes beyond the Sponsor' control, which corrupt the integrity, administration, security or proper operation of the Sweepstakes, Sponsor reserves the right, in their sole discretion, to modify, cancel or suspend the Sweepstakes. In the event of cancellation, Sponsor reserves the right to select winner from among all eligible, non-suspect entries received prior to the event requiring such cancellation. False or deceptive entries or acts will render the entrant ineligible. Each entrant hereby acknowledges and agrees that the relationship between entrant and Sponsor is not a confidential, fiduciary, or other special relationship, and that entrant's decision to submit his/her entry to Sponsor for purposes of the Sweepstakes does not place Sponsor in a position that is any different from the position held by members of the general public with regard to elements of entrant's Submission. All entries become the property of Sponsor and will not be acknowledged or returned.

How Winner will be Determined: The Winner will be selected in a random drawing on or about August 26, 2009 from among all eligible entries received. Winner will be selected by an independent judging organization, and will be contacted by phone and/or confirmed in writing within seven (7) days of drawing. Judge's decisions with respect to winner and other matters pertaining to the Sweepstakes shall be final. The odds of winning will depend upon the number of eligible entries received.

GENERAL TERMS & CONDITIONS: The prospective Grand Prize Winner will be required to sign an Affidavit of Eligibility, Release of Liability and where allowable, a Publicity Release, and return same, properly executed, within ten (10) days of issuance of prize notification. Such documents will be binding and effective upon signature, and shall encompass all Sweepstakes Entities. If Sponsor is unable to contact the prospective winner, if the prospective winner fails to complete and return all requested forms by the specified date, or if the prospective winner fails to comply with any of the requirements of these Official Rules, his/her prize will be forfeited and an alternate winner shall be selected. By entering the Sweepstakes, all entrants consent to the use of their name, photograph, likeness, biography, voice and/or video for advertising and promotional purposes, including online announcements, worldwide and without limitation and without additional compensation, except where prohibited by law.

In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holders of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY'S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

The Sweepstakes Entities expressly disclaim any responsibility for, and entrants agree to indemnify and hold harmless the Sweepstakes Entities from, any and all claims, actions, demands and/or liability for injury, damage or loss whatsoever relating to or arising in connection with participation in this Sweepstakes (regardless of the cause of such injury, damage or loss) and/or the delivery and/or subsequent use or misuse of any of the prizes awarded.
